A Quick Reference to Indiana Bankruptcy Exemptions

Indiana bankruptcy law does not allow federal exemptions to be used in place of or in addition to state exemptions. Debtors filing for bankruptcy are confined to using the Indiana state exemptions. These include:

Homestead: Property used as a residence by the debtor is exempt up to $15,000. Property held in entirety may be exempt if only one spouse files for bankruptcy. Husband and wife may not double.

Personal property: Health aids, medical care savings, spendthrift trusts and all intangible personal property except money owed to the debtor.

Insurance: Life insurance, mutual life or accident proceeds, group life insurance and employer life insurance on employee.

Pension: Firefighters pension, police officers pension, public employees pension, public or private retirement benefits, sheriffs' pension, state teachers' pension and federal pension exemptions.

Public benefits: Crime victims' compensation, unemployment compensation and workers' compensation.

Tools of trade: National Guard uniforms, arms and equipment.

Wages: At least 75 percent of unpaid disposable weekly wages or 30 times the federal minimum wage.

Wild card: Tangible personal property up to $8,000.
