A Quick Look At Florida Bankruptcy Exemptions
Florida does not allow federal exemptions to be used in addition to state exemptions. Florida bankruptcy exemptions are fairly liberal but the crunch has taken its toll. To compensate for this, Florida bankruptcy state laws now allow debtors to claim more on personal property exemptions if they do not qualify for homestead exemptions.
Homestead: Unlimited value for up to ½ acre within a municipality and 160 acres outside a municipality. This includes mobile homes.
Personal Property: Up to $1000 for a single person and $2000 for a married couple. Deposits into prepaid college trust fund, deposits into prepaid medical savings account, deposits into prepaid hurricane savings, federal income tax refund and credit, health aids, car up to $1000 and deposits for funeral contracts.
Insurance: All death benefits payable to a beneficiary, life insurance, illness and disability and fraternal benefit society payments.
Pensions: State officer and employee pensions, county officers and employee pensions, firefighter, police officer, Roth IRAs and ERISA qualified benefits.
Public Benefits: Public assistance, social security, unemployment benefits, veterans' benefits and workers compensation.
Tools of your Trade: None.
Wages: Head of the family - all wages up to $500/week, wages deposited into bank account - $500/week up to 6 months after deposit, federal government employee pension (provided it is received 3 months before collection of money).
